Welcome to Kiddo Suite! These Terms and Conditions govern your access to and use of our platform. By using our services, you agree to comply with these terms. If you do not agree, please refrain from using our platform.

1. Account Registration

• To access and use our platform, you are required to register for an account. By registering for an account, you consent to providing us whatever information you enter.
• You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

2. Subscription and Fees

• Upon signing up, you receive a free 30-day trial to explore our platform.
• Subscription fees are payable upfront. Fees are non-refundable unless otherwise specified.
• If you cancel your subscription, your data will be anonymised and no longer identifiable.

3. Data Protection and Privacy

• We are committed to protecting your personal information in compliance with the Protection of Personal Information Act (POPIA) in South Africa.
• By using our platform, you consent to our data processing practices as outlined in our Privacy Policy.
• Personal data will only be shared with third parties when necessary to fulfill our services or as required by law.

4. Anonymisation of Data

• Upon cancellation of your subscription, your data will be securely anonymised. This means that while we may retain anonymised, non-identifiable data for analytical and system improvement purposes, no personal information will remain linked to you.

5. User responsibility

• You are responsible for maintaining the confidentiality of your account credentials.
• You must ensure that all data entered into the platform is accurate and up-to-date.
• You are responsible for ensuring your ECD's compliance with all applicable data protection and other laws.

6. System Availability

• We aim to ensure the platform is available 24/7 but cannot guarantee uninterrupted service due to maintenance, updates, or unforeseen issues.
• We will notify users of scheduled downtime whenever possible.

7. Third-Party Data Storage

8. Intellectual Property

• All intellectual property rights related to the platform are owned by NexaNovel Technologies.
• You are granted a non-exclusive, non-transferable license to use the platform for its intended purpose.

9. Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

10. Limitation of Liability Regarding Third-Party Hosting Services

• NexaNovel Technologies shall not be held liable for any disruptions, data breaches, loss of data, or damages resulting from actions or events beyond our control, including but not limited to the cessation of services by the third-party hosting company, server downtime, or security breaches occurring within the third-party infrastructure. Users acknowledge that NexaNovel Technologies does not directly host servers or databases and thus cannot guarantee the continuous availability or security of the service under such circumstances.

11. Termination

• We reserve the right to terminate your access to the platform for violations of these terms.
• Upon termination, all data will be anonymised as per our data protection policy.
• Should your license expire, and 30 days elapse thereafter, your account and all your data will be deleted i.e. anonymised. This means that you'll have to register for a new account again and start using the platform from scratch.

12. Amendments to Terms

• We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
• By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the platform.
